France data protection watch dog fined Tik Tok with 5 million euros for breaking rules on cookie consent.
The fine relates to cookie consent flow of Tik Tok in which regulator found that it was easy for the users to give consent but it was difficult for them to opt out. CNIL found that tik tok is manipulating the user’s consent by making it easier for the website users to accept its tracking than to opt out.
In the investigation it was found that while tik tok putted buttons to accept all the cookies immediately, they do not put equivalent solution/button to withdraw their consent easily. While the cookie could be accepted in just one click by clicking on accept all button, several clicks were necessary to withdraw their consent. By doing this Tik Tok has breached Article 82 of French Data Protection Act since it was not not as easy to refuse cookies than to accept them.
CNIL also found that Tik Tok has not informed users in a precise manner the purpose of cookies and hence breached Article 82 of French Data Protection Act.
