In the matter of SANJAY R HEGDE v. THE MINISTRY OF ELECTRONICS AND INFORMATION TECHNOLOGY AND ANR. [ W.P.(C) 13275/2019 & CM APPL. 53972/2019, CM APPL. 5543/2020], ASG Mr. Chetan Sharma informed Delhi High Court that Government will setup an Grievance Appellate Committee to redress the grievances of social media users against platforms like twitter and facebook on hosting contentious content on their platforms. Mr. Sharma submitted the notification dated 28th October,2022 of MINISTRY OF ELECTRONICS AND INFORMATION TECHNOLOGY wherein Rule 2(1)(ka) has been inserted in Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2022 (“Rules”). It provides that :
“Grievance Appellate Committee” means a grievance appellate committee constituted under rule 3A.
Rule 3A provides for constitution,composition and functions of Grievance Appellate Committee. Rule 3A(1) further states that the Central Government shall, by notification, establish one or more Grievance Appellate Committees within three months from the date of commencement of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2022 i.e from 28th October,2022.
The matter will now be heard on 16.02.2023.
