Meghalaya government has filed a suit against the decision of other states to ban the sale of Meghalaya’s lottery tickets within such states. The suit challenges Section 5 of the Lotteries (Regulation) Act, 1998 wherein the Central government has authorized the State governments to prohibit sale of tickets of lottery organized, conducted or promoted by other state.
The State of Meghalaya submitted that regulation on lotteries organized or conducted by another state is not a state subject but falls under the Centre’s domain therefore states should not be granted permission to disallow sale of lottery tickets within their territory which is conducted by another state.
However, on Monday, Attorney General Of India Mr. Venkatramani informed Honb’ble Apex court that such a suit is not maintainable. However, Mr. Rohatgi told Apex court that question as to whether Section 5 of the Lotteries (Regulation) Act, 1998 is valid or invalid is purely a legal question and hence suit will be maintainable under section 9 of C.P.C.
